  5. Submit an agency-specific FOIL request by email, mail, counter, or the county form when an ordinary inquiry does not produce the record.

For Watkins Glen Police records, request the department's report through the village channel. A New York State Police arrest must go through the NYSP records-request process, not county FOIL. State Police records can also include investigation material whose release is delayed or restricted.

Give each custodian enough detail to distinguish the event without making the request needlessly broad. Helpful facts include the incident or booking number, a narrow date and time range, location, arresting agency, transport destination, and exact record type. If the question concerns a court-issued bench warrant or arraignment result, ask the issuing court. No separate certified-copy fee, search fee, card rule, or guaranteed turnaround is published. Ask before sending payment. Active investigations, sealed information, juvenile material, victim-sensitive facts, and security records may be withheld or redacted.

Email provides a direct written route for sheriff-specific records. Mail and counter requests use the same Unit 2 address. Fax is published, but the sheriff's page does not expressly state that a FOIL request may be filed by fax, so confirm first. The county's online form is useful for county-wide routing. The county's online FOIL form provides a second route when the custodian is a county office. County rules require an initial response within five business days. The county may grant or deny access, seek clarification, or acknowledge the request with an approximate decision date. That date ordinarily should not exceed 20 business days after acknowledgment, unless the county explains the delay and gives a reasonable new date. This rule does not turn State Police files into county records, and court case files must be requested from court clerks under Judiciary Law §255.

If access is denied, the county's rules provide for a written appeal to the designated FOIL appeals officer. A denial should explain those rights. Requesters may also narrow a broad request or ask for nonexempt portions after redaction. DCJS rap sheets remain outside this process because the official state repository record is not a public county record.

An arrest entry proves only that an agency recorded an arrest. Charges may be declined, dismissed, reduced, or changed by indictment. The authoritative next step is the disposition for each filed count. A court judgment, not a booking photo or press release, establishes a conviction.

Correcting Schuyler County Arrest History
